Welcome to E MART.

These Terms of Service (“Terms”) govern your use of the E MART website, online store and related services, including your purchase of products from us.

The terms “E MART,” “we,” “us” and “our” refer to E MART, operated by Abidullah Lodin in Ireland.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer products and services to you.

Please read these Terms carefully before using our website or placing an order.

By accessing our website or purchasing from E MART, you agree to these Terms together with our:

  • Returns & Refunds Policy

  • Shipping Policy

  • Other policies displayed on our website

Nothing in these Terms limits or excludes any mandatory rights available to consumers under applicable Irish or European Union consumer law.

If a provision of these Terms conflicts with a mandatory consumer right that cannot legally be excluded, the mandatory consumer right will apply.

2. Eligibility and Customer Accounts

You must have the legal capacity required under applicable law to enter into a purchase contract with us.

When you provide information to E MART, including when placing an order or creating an account, you agree to provide information that is accurate, complete and current.

  • Delivery address

If you create a customer account, you are responsible for keeping your login credentials confidential and for taking reasonable measures to prevent unauthorised use of your account.

The appearance of colours and products may vary slightly depending on your device, screen settings, lighting and photography.

Minor visual differences that do not affect the product's conformity with the sales contract may therefore occur.

However, nothing in this section limits your legal rights where a product is:

  • Faulty

  • Damaged

  • Incorrect

  • Materially different from its description

  • Not fit for its intended or agreed purpose

  • Otherwise not in conformity with the sales contract

We may change or discontinue products offered through the website, provided this does not affect orders already accepted by us or your statutory rights.

4. Product Availability

Products are subject to availability.

Occasionally, a product may become unavailable after an order has been placed because of circumstances such as:

  • Supplier stock changes

  • Inventory errors

  • Product discontinuation

  • Fulfilment issues

  • Legal or regulatory restrictions

If we cannot fulfil an accepted order, we will contact you and provide an appropriate refund where payment has already been taken.

We will not substitute a materially different product without your agreement.

5. Orders

When you submit an order through our website, you are requesting to purchase the selected products.

You will normally receive an electronic acknowledgement confirming that we have received your order.

An acknowledgement of receipt does not necessarily mean that the order has been finally accepted.

An order may be declined or cancelled before acceptance for legitimate reasons including:

  • Product unavailability

  • Payment failure

  • Suspected fraud

  • An obvious pricing or product-listing error

  • Delivery restrictions

  • Legal or regulatory restrictions

  • Inability to fulfil the order

If we cancel an order after payment has been taken, we will refund the amount due using the original payment method unless another method is agreed or required by law.

We will not cancel an accepted consumer order in a manner that removes statutory rights available to you.

Before submitting an order, please carefully check:

If you discover an error after placing an order, contact us immediately at support@emartonline.store.

We will try to make the requested change before fulfilment begins, but we cannot guarantee changes once an order has entered fulfilment or has been dispatched.

Your statutory cancellation and return rights are not affected.

7. Prices

The price charged will be the price displayed or otherwise communicated to you as part of the ordering process, subject to correction of obvious errors where legally permitted.

Where required by applicable law, prices displayed to consumers will include applicable taxes.

Before you place an order, we will provide information about any additional charges that apply to the transaction, such as:

  • Delivery charges

  • Shipping charges

  • Other mandatory charges

Where a charge cannot reasonably be calculated in advance, we will provide the information required by applicable law regarding how it will be calculated or the possibility that such a charge may apply.

You will not be responsible for additional charges that applicable consumer law requires us to disclose before purchase but that were not properly disclosed.

8. Obvious Pricing Errors

We try to ensure that product prices are accurate.

Occasionally, an obvious technical or human error may result in an incorrect price being displayed.

Where permitted by law and an obvious pricing error is identified before the contract is completed or fulfilled, we may contact you to:

  • Confirm whether you wish to purchase at the correct price; or

  • Cancel the affected order and refund any payment already collected.

This section does not allow E MART to arbitrarily increase the agreed price after a valid sales contract has been concluded.

9. Payments

Available payment methods are displayed during checkout.

Payments may be processed by Shopify Payments or other authorised payment providers.

By submitting payment information, you confirm that:

  • The information is accurate;

  • You are authorised to use the selected payment method; and

  • The payment provider is authorised to process the transaction.

We may use reasonable fraud-prevention and payment-verification procedures.

Payment processing is also subject to the applicable payment provider's terms and security procedures.

10. Shipping and Delivery

We will provide available shipping information during the ordering process or in our Shipping Policy.

Delivery times shown on our website are estimates unless we expressly agree to a specific guaranteed delivery date.

Actual delivery times can depend on factors such as:

  • Destination

  • Product availability

  • Fulfilment location

  • Courier service

  • Customs procedures where applicable

  • Public holidays

  • Severe weather

  • Events outside reasonable control

We will fulfil our delivery obligations within the timeframe agreed with you and in accordance with applicable consumer law.

If no specific delivery period has been agreed, the applicable statutory delivery requirements will apply.

If an order is materially delayed, contact support@emartonline.store so that we can investigate.

Nothing in these Terms removes any statutory right you may have where goods are not delivered within the required period.

11. Risk During Delivery

Where consumer law applies, the goods generally remain at E MART's risk until you, or another person nominated by you to receive the goods, obtains physical possession of them.

If you independently arrange a carrier that was not offered or proposed by E MART, different rules regarding transfer of risk may apply.

You should inspect your package reasonably promptly after delivery and contact us if it appears:

  • Damaged

  • Incomplete

  • Incorrect

  • Tampered with

12. Dropshipping and Fulfilment Partners

E MART may use third-party suppliers, warehouses, fulfilment partners and logistics providers to prepare and deliver certain orders.

As a result:

  • Products in the same order may sometimes be shipped separately;

  • Different products may be dispatched from different locations;

  • Different couriers may be used;

  • Tracking information may be issued separately.

Your purchase contract remains with E MART.

The use of a supplier or fulfilment partner does not remove E MART's obligations to you under applicable consumer law.

Where necessary to fulfil an order, relevant customer information may be provided to suppliers, fulfilment partners and delivery providers in accordance with our Privacy Policy.

13. International Shipping, Customs and Import Charges

Where products cross international borders, customs procedures may affect delivery times.

Where additional import duties, customs charges or similar mandatory costs may apply to an order, information about those charges will be provided as required by applicable law before you become bound by the purchase.

We will not require you to pay undisclosed additional charges where consumer law requires those charges to have been disclosed before purchase.

14. Returns, Cancellations and Refunds

Returns, order cancellations and refunds are governed by our Returns & Refunds Policy, available on our website.

Where applicable, consumers purchasing online may have a statutory right to cancel eligible purchases during a cooling-off period.

If a product is faulty, damaged, incorrect, not as described or otherwise not in conformity with the sales contract, you may have statutory remedies.

Depending on the circumstances and applicable law, remedies may include:

  • Replacement

  • Refund

  • Termination of the sales contract

Where Irish consumer law applies, additional rights may apply where a fault is identified within the initial period after delivery.

Nothing in these Terms replaces or reduces your statutory rights concerning faulty goods.

16. Commercial Warranties

Some products may include a manufacturer's or supplier's commercial warranty.

Any commercial warranty is additional to, and does not replace or reduce, statutory consumer rights.

Where applicable, warranty information supplied with a product should be reviewed together with your statutory rights.

17. Promotions and Discount Codes

From time to time, E MART may offer:

  • Discount codes

  • Sales

  • Promotions

  • Special offers

Promotions may be subject to additional conditions clearly communicated with the offer.

Unless otherwise stated:

  • Discounts cannot be exchanged for cash;

  • A promotional code may have an expiry date;

  • A promotion may apply only to specified products or customers;

  • Multiple promotional codes may not always be combined.

Promotional conditions do not remove statutory consumer rights.

Discounted or sale products remain subject to applicable rights concerning faulty or non-conforming goods.

18. Intellectual Property

The E MART website and its original content, including applicable:

  • Brand elements

  • Logos

  • Graphics

  • Website design

  • Written content

  • Images

  • Videos

may be protected by copyright, trademark and other applicable intellectual-property laws.

Some product photographs, descriptions, trademarks and other materials may belong to our suppliers, manufacturers, Shopify or other third-party rights holders and are used under applicable rights or permissions.

You may use the website for lawful personal shopping purposes.

Unless permitted by law or by the relevant rights holder, you must not:

  • Copy substantial portions of the website;

  • Republish protected E MART content;

  • Falsely represent E MART branding as your own;

  • Use our website to infringe another person's intellectual-property rights.

All third-party trademarks remain the property of their respective owners.

19. Reviews, Feedback and Customer Content

If our website allows you to submit a product review, comment, photograph or other content, you are responsible for ensuring that you have the right to submit it.

Content submitted by you must not:

  • Be unlawful

  • Be knowingly false or misleading

  • Infringe intellectual-property rights

  • Violate another person's privacy

  • Contain malicious software

  • Constitute abusive, threatening or discriminatory material

  • Misrepresent your identity or experience with a product

By submitting content for publication, you grant E MART a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating, improving and promoting E MART, subject to applicable law and privacy rights.

You retain ownership of rights you already hold in your content.

We may remove unlawful or inappropriate content where reasonably necessary.

20. Third-Party Services and Links

Our website may contain links to websites, services or applications operated by third parties.

Third-party services may include:

When you leave the E MART website and use an independent third-party service, that third party's terms and privacy policies may apply.

E MART is not responsible for the independent operation of websites or services that we do not control.

21. Relationship With Shopify

E MART is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our store are made directly between you and E MART.

Shopify provides the ecommerce technology supporting the store but is not the seller of E MART products.

To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, losses or liabilities arising solely from products sold directly by E MART.

Nothing in this section limits your rights against E MART as the trader responsible for your purchase or any rights that cannot legally be excluded.

22. Privacy

Our collection and processing of personal information is governed by our Privacy Policy.

Our Privacy Policy explains matters including:

  • Information we collect

  • How information is used

  • Legal bases for processing where applicable

  • Sharing with Shopify and service providers

  • Fulfilment and delivery processing

  • Cookies

  • Marketing

23. Website Availability

We aim to keep the E MART website available and functioning properly.

However, we cannot guarantee that the website will always be:

  • Exclude liability for death or personal injury where such liability cannot legally be excluded;

  • Exclude any other liability that applicable law does not permit us to exclude.

Subject to those protections, E MART will not be responsible for losses that were not reasonably foreseeable as a consequence of our breach or that arise from circumstances for which we are not legally responsible.

If you purchase as a consumer, these Terms do not restrict remedies that applicable consumer law gives you.

27. Events Outside Reasonable Control

E MART will not be responsible for a delay caused solely by events outside our reasonable control to the extent permitted by applicable law.

Examples may include:

  • Severe weather

  • Natural disasters

  • War

  • Civil disturbance

  • Government restrictions

  • Major transport disruption

  • Major telecommunications or infrastructure failures

Where such an event affects an order, we will take reasonable steps to minimise disruption and communicate with you where appropriate.

Your statutory rights regarding significant delivery delays or non-delivery remain unaffected.

28. Suspension or Termination of Website Access

We may suspend or terminate access to an E MART customer account where reasonably necessary because of:

  • Fraud

  • Unlawful activity

  • Serious misuse of the website

  • Security threats

  • Material breach of these Terms

Termination of website access does not remove obligations concerning orders already accepted or rights that arose before termination.

Provisions that by their nature should continue after termination will remain effective.

29. Consumer Contract Fairness

These Terms are intended to be interpreted consistently with applicable consumer-protection law.

If a provision is determined to be unfair, unlawful or unenforceable against a consumer, that provision will not bind the consumer to the extent required by law.

Where possible, the remainder of these Terms will continue to apply.

Nothing in these Terms requires a consumer to waive a statutory right that cannot legally be waived.

30. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.

31. No Waiver

If E MART does not immediately enforce a right under these Terms, that does not necessarily mean that the right has been waived.

Any waiver will apply only to the particular circumstances for which it was given.

32. Entire Agreement

These Terms, together with policies incorporated into them, constitute the terms governing your use of the E MART store and purchases from us, subject always to:

  • Mandatory consumer law;

  • Information that forms part of your individual sales contract;

  • Specific written terms expressly agreed between E MART and you.

Nothing in this section permits E MART to disregard representations or information that applicable law makes binding as part of a consumer contract.

33. Assignment

You may not transfer your customer account to another person without our permission.

E MART may transfer business rights or obligations as part of a legitimate business restructuring, transfer or sale only to the extent permitted by applicable law.

Any transfer will not reduce statutory rights or place a consumer in a materially worse contractual position where applicable law prohibits this.

34. Governing Law

These Terms and contracts concluded with E MART are generally governed by the laws of Ireland.

However, if you are a consumer resident in another country and E MART directs its commercial activities to that country, this choice of Irish law does not deprive you of mandatory consumer protections that apply to you under applicable law.

Nothing in these Terms restricts a consumer's right to bring proceedings before a court that has jurisdiction under applicable consumer and European Union law.

35. Changes to These Terms

We may update these Terms from time to time because of:

  • Changes to our business;

  • Changes to our Services;

  • Changes to Shopify features;

  • Changes to applicable law;

  • Operational requirements;

  • Security requirements.

The latest version will be displayed on our website with an updated “Last updated” date.

Material changes will apply prospectively as required by applicable law.

Changes to these Terms will not retroactively remove rights already acquired under an existing order or contract where this would be unlawful.
